DDP FOODS LLP TERMS AND CONDITIONS

This Platform is operated by DDP Foods LLP, hereinafter referred to as "DDP Foods". This document, i.e., the Terms of Use (“Terms”) contains the terms and conditions between DDP Foods LLP (“we”, “our”, “us”) that owns and controls the brand known as ‘Indian Chimnee’ and you, the user of the Platform (“User”, “you”, “your”). DDP Foods LLP is a limited liability partnership incorporated under the Limited Liabilities Partnership Act, 2008 in India and having its registered office at DDP Foods LLP, SE -127 , Jaipuria Sunrise Green ,Ahinsa Khand , Indirapurum , Ghaziabad ,201014

To make this reader-friendly, we have divided these Terms of Use into four sections:

1.Acceptance of the Terms

DDP Foods LLP offers services and sale and delivery of its products through this Platform (“Services”), conditional to your acceptance of these Terms. Your acceptance of these Terms is essential for us to provide our Services safely and seamlessly, in accordance with the applicable law(s).

Please read these Terms very carefully. If you do not agree to these Terms, DDP Foods LLP will not be able to provide any of its Services to you. By accessing or viewing the Platform and/or using the Services, you represent that you have read the Terms and agree to be bound by the same.

These Terms, together with any other terms that you may agree to by reference, constitute a legally binding agreement (“Agreement”) between you and DDP Foods LLP.

We may amend/modify these Terms at any time, and such modifications shall be effective immediately upon posting on the Platform. We will, wherever possible, attempt to notify you of any changes to the Terms by way of push notifications and/or pop-ups and/or e-mails. Your continued use of our Services will constitute your agreement to any changes we make.

If you do not agree to the Terms & Conditions as may be modified from time to time, you have the option to not avail or discontinue from availing our Services.

2.TERMS OF USE OF THE WEBSITE

Legal Age and Eligibility: You must be of legal age and eligible to enter into a binding contract. If you are a minor, your access will be considered valid only with legal guardian authorization.

Corporate User: If acting on behalf of an entity, you confirm the authority to accept Terms on its behalf.

Advertisement and Promotions: By using our platform, you consent to receive promotional content related to our services.

Restrictions: You agree not to misuse the platform for any illegal, harmful, or disruptive activities, including but not limited to posting obscene content, violating copyrights, impersonation, using bots/viruses, or disrupting our infrastructure.

Pricing: Product prices are subject to correction for errors. If pricing errors occur, DDP Foods LLP may cancel orders and request re-payment.

Intellectual Property Rights: All platform content belongs to DDP Foods LLP or its licensors. Users do not obtain rights to our intellectual property by using the platform.

Third-Party Services: Our services may link to third-party content, which is governed by separate terms. We are not responsible for external content.

Privacy Policy: Our Privacy Policy describes how we collect, use, and protect your information. It is an integral part of these Terms.

3.GENERAL TERMS & CONDITIONS OF SALE

Subscription: To avail our Indian Chimnee meal services, users may subscribe to a suitable plan. Subscriptions are linked to the registered mobile number used for login.

Order: Completion of checkout does not imply order acceptance. Acceptance depends on payment confirmation and availability.

Payment: Payments are processed through third-party gateways. Users are responsible for providing valid details. Charges include taxes, delivery fees, and gateway transaction fees.

Delivery: Indian Chimnee currently delivers in parts of Delhi NCR including Ghaziabad, Indirapuram, Noida, and East Delhi. Deliveries are scheduled from Monday to Saturday, usually between 7:30 AM and 10:00 AM. Delays may occur due to unforeseen conditions. Meals may not be delivered on public holidays; customers will be notified.

Returns, Exchanges, Cancellations: In case of defective or incorrect meals, users must notify us within 4 hours with images. Valid claims will result in a replacement or subscription extension. Taste preferences or minor visual differences do not qualify.

4.LEGAL TERMS & CONDITIONS

Disclaimers: DDP Foods LLP provides nutritious vegetarian food and services. However, we do not accept responsibility for any adverse health effects resulting from the consumption of meals or use of our services. We expressly disclaim all liabilities regarding the performance, accuracy, and reliability of our services. Nothing on the platform constitutes medical advice or our official opinion.

Nutritional Services: We rely on the information you provide and are not responsible for any health issues caused due to your failure to disclose relevant details. Consult a physician before subscribing to our plans.

Wallet Usage: DDP Foods LLP reserves the right to amend wallet policies without prior notice. By using the service, you agree to these terms.

We do not guarantee results related to weight, nutrition, or health. Individual results may vary based on lifestyle and health history.

You accept and assume any risk associated with using our services.

Platform Liability: We are not responsible for technical disruptions, equipment failure, or maintenance-related issues that impact service. You are responsible for your internet access and hardware.

Third-Party Delivery: We use third-party delivery partners and are not liable for delays, errors, or issues in delivery arising from them.

Force Majeure: We are not responsible for delay/failure due to events like natural disasters, war, pandemic, lockdown, etc.

Indemnity: You agree to indemnify and hold DDP Foods LLP and its affiliates harmless from any claims or liabilities arising from breach of Terms or misuse of services.

Limitation of Liability: DDP Foods LLP will not be liable for indirect or consequential damages. Liability is capped at the total paid value of the service or product.

All claims must be raised within 30 days of the issue or will be considered waived.

Governing Law and Jurisdiction: This agreement is governed by the laws of India. The courts of Ghaziabad shall have exclusive jurisdiction.
